Terms of Service

The Photographer hereby grants the Client a non-exclusive, non-transferable, perpetual license to use the delivered photographs and/or videos ("Media") solely for the purpose of marketing the property referenced in this agreement for rent or sale. This includes:

• Use on MLS listings, real estate websites, rental platforms, and social media;
   
• Printed and digital brochures, flyers, and other sales materials.
   

Any use of the Media for other purposes, including resale, portfolio use, or third-party advertising, is strictly prohibited unless approved in writing by the Photographer.

a. Media may only be used to promote the property identified at the time of the shoot.
b. Use of the Media for future listings, different properties, or for business branding purposes is not permitted without additional licensing.
c. Any editing, cropping, or modification must be approved by the Photographer in writing.

If the Media is published in any editorial, print, or public-facing platform where credit is customary or permitted, the Client agrees to credit the Photographer as:

a. All copyrights and ownership of the original Media remain with the Photographer.
b. This agreement provides a limited license for use of the Media only as described in Section 1.
c. No ownership or transfer of copyright is implied or granted.

Invoices are due within 30 calendar days of receipt. Late payments may be subject to a late fee of 5% per month on any overdue amount.
The Photographer reserves the right to withhold delivery or revoke usage rights if payment is not made in accordance with this section.

This license may be revoked if the Client breaches any terms of this Agreement. Upon termination, the Client must cease all use of the Media and delete all files from their possession.

a. This Agreement represents the entire understanding between the parties and supersedes all prior discussions or agreements.
b. Any modifications must be made in writing and signed by both parties.
c. This Agreement shall be governed by the laws of the State
